NOTICE TO CONTRACTORS
FOR CONSTRUCTION OF

PERIMETER FENCING 

AIP PROJECT NO. 3-06-0241-28

GENERAL INFORMATION

 A. Notice is hereby given that the 

COUNTY OF SONOMA
DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS

STATE OF CALIFORNIA 

will accept bids for construction of: 

PERIMETER FENCING 
AIP PROJECT NO. 3-06-0241-28

County Job No. W09567

 The project location is the Charles M. Schulz-Sonoma County Airport.  The work consists of, in general, removal of approximately 1,200 linear feet of existing airport fencing; removal of trees and other vegetation in the pathway of proposed new fencing; installation of 14,400 feet of 8-foot chain link fence, and 7.850 feet of field fence; installation of 21 gates around the Airport perimeter; storm water pollution prevention.  Bidding Documents contain the full description of the Work.  County Project W09567.

 B. Sealed Bids will be received  by the Clerk of the Board of Supervisors, Room 100A, 575 Administration Drive, Santa Rosa, CA 95403, until 2:00 p.m., as determined by the clock on the wall of the office of the Clerk of the Board of Supervisors, on June 29, 2005, at which time they will be transferred to the Sonoma County Department of Transportation and Public Works Meeting Room (Room 117A) Where they will be publicly opened and read aloud by the Sonoma County Director of Transportation and Public Works or his designee.  Said bids will be referred to the Sonoma County Board of Supervisors for consideration after evaluation by the Department of Transportation and Public Works staff.

 C. Contract documents may be examined at the office of the Airport Manager, 2290 Airport Boulevard, Santa Rosa, California 95403,  telephone (707-565-7243.

 D. Copies of contract documents may be obtained upon application to County of Sonoma, Department of Transportation, 2300 County Center Drive, B-100, Santa Rosa, California, 95403, and upon payment of a nonrefundable fee of $75.00.  Only checks payable to County of Sonoma will be accepted.  No cash is accepted.

 TIME OF AWARD:

 The contract, if it is to be awarded, will be awarded within 120 days from the date of the bid opening, unless the County obtains the consent of the bidder to extend time of award.

TIME FOR COMPLETION:

All contract work shall be completed within ninety (90) calendar days from the date of a Notice to Proceed.

Liquidated damages for this project have been set at Fifteen Hundred Dollars ($1,500.00) for each calendar day the project exceeds the number of days allowed above.

BID WITHDRAWAL: 

No bidder shall withdraw his bid for 120 days after opening.

 BID BOND: 

Bids shall be accompanied by one of the following forms of bidder's security: cashier's check, certified check, or a bidder's bond executed by an  admitted surety insurer authorized to transact business in this state, made payable to the County of Sonoma.  The security shall be in an amount equal to or at least ten percent  (10%) of the amount of the base bid.  A bid shall not be considered unless one of the forms of bidder's security is enclosed with it.  A bidder's bond will not be accepted unless it has been properly filled out and executed by the surety and by the bidder.

 DISADVANTAGED BUSINESS ENTERPRISES: 

Disadvantaged business enterprises (DBEs) as defined in 49. CFR Part 26 shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with federal funds under this agreement.  Consequently, the DBE requirements of 49 CFR Part 26 apply to this agreement.  However, the employment of women shall not diminish the standards of requirements for the employment of minorities.  DBE goals for this project have been set at nine percent (11%).

 WAGE RATES AND EQUAL EMPLOYMENT OPPORTUNITY

 Bidders are hereby given notice that this project has both State and Federal funding.  The successful bidder shall comply with State Prevailing Wage Laws and Federal Requirements identified in this Notice and the contract documents.  To the extent that there is a discrepancy between the State and Federal requirements, bidder shall comply with the highest dollar amount and/or the most stringent requirement.

 The successful Bidder must comply with all prevailing wage laws applicable to the Project, and related requirements contained in the Contract Documents.  Copies of general prevailing rates of per diem wages for each craft, classification, or type of worker needed to execute the Contract, as determined y the Director of the State of California Department of Industrial Relations, are on file at the Sonoma county Department of Transportation and Public Works Main  office and are deemed included in the Bidding documents.  Upon request, County will make copies available to any interested party.  Contractor shall post the applicable prevailing wage rates at this site.

The proposed contract is under and subject to Executive Order 11246, as amended, of September 24, 1965, and to the Equal Employment Opportunity (EEO) and Federal Labor Provisions.  All labor on the project shall be paid no less than the higher of either the prevailing state wage rates established by the State of California, Director of the Department of Industrial Relations, or the prevailing federal wage rates established by the U.S. Secretary of Labor. 

The EEO requirements, labor provisions, and wage rates are included in the Specifications and Bid Documents and are available for inspection at the Office of the airport Manager, Sonoma County Airport, 2290 Airport Boulevard, Santa Rosa, California 95403.  Each bidder must complete, sign, and furnish with his bid the "Bidder's Statement on Previous Contracts Subject to EEO Clause," a "Certification of Nonsegregated Facilities," and the "Assurance of Disadvantaged Business Enterprises Participation," as contained in the Bid Proposal.

 To be eligible for award, each bidder must comply with the affirmative action requirements which are contained in the Specifications.  A contractor having 50 or more employees and his subcontractors having 50 or more employees and who may be awarded a contract of $50,000 or more will be required to maintain an affirmative action program, the standards for which are contained in the Specifications. 

FOREIGN TRADE RESTRICTIONS:

 All solicitations, contracts, and subcontracts resulting from projects funded under this contract are subject to the foreign trade restriction required by 49 CFR Part 30, Denial of Public Works Contracts to Suppliers of Goods and Services of Countries That Deny Procurement Market Access to U.S. Contractors.  The Aviation Safety And Capacity Expansion Act of 1990 provides that preference be given to steel and manufactured products produced in the United States when funds are expended pursuant to a grant issued under the Airport Improvement Program.

 CONTRACTOR'S LICENSE:

 The successful bidder must possess a State of California Class A license at the time of contract award and through completion of the Project.  All contractors and subcontractors shall be properly licensed by the Contractor's License Board and possess the necessary license classification for the work they perform under this project.

 SUBSTITUTION OF SECURITIES:

 Owner will permit successful Bidder to substitute securities for retention monies withheld to ensure performance of Contract, as set forth in Document 00680 (Escrow Agreement for Security Deposits in Lieu of Retention), in accordance with California Public Contract Code, Section 22300.  By this reference, Document 00680 (Escrow Agreement for Security Deposits in Lieu of Retention) is incorporated in full by this Notice.

 OWNER'S RIGHTS RESERVED:

 The County reserves the right to reject any and all bids and waive any informalities or irregularities in the bidding, and to delete or eliminate entirely any separable unit price or lump sum item of the proposed project.

 PRE-BID WALK-THROUGH:

 A pre-bid conference and walk-through is scheduled for 9:00 a.m., June 8, 2005.  The conference will be held in the Airport Fire Station, 2200 Airport Boulevard.  All prospective bidders are encouraged to attend.  Representatives of the County and Mead & Hunt will be present to discuss the project, receive questions, and conduct a tour of the airport.  At all other times, Contractor access onto the Airport must be coordinated and supervised by the County available on a limited basis.  Contact the Airport Manager's office at (707) 524-7243 to schedule airfield visits.

 SUBCONTRACTORS:

 In accordance with California Public Contracts Code Section 4100 to 4113, inclusive, each bidder shall provide a list giving the name and location of place of business of each subcontractor who will perform a portion of the contract work in an amount in excess of one-half of one percent of the total contract price.  In each instance, the nature and extent of the work to be sublet shall be described.

 FUNDING: 

Owner advises potential Bidders that the Project is funded in whole or part with grant funds through Federal Transportation Administration Airfield Improvement Program (AIP) grant project No. 3-06-0241-28.

 STATEMENT OF QUALIFICATIONS:

 Each bidder shall submit a Statement of Qualifications for Construction Work in conformance with Document 00450.

 BID PREPARATION COST:

 Bidders are solely responsible for the cost of preparing their bids.
