Important Instructions

  • All forms listed under each permit type must be completed for that permit type. For example: Zoning Permit – Vacation Rentals requires that PJR-001, PJR-011, PJR-096, and PJR-119 all be completed. Incomplete submissions will result in delays.

  • Use form PJR-001 instead of PJR-004. Form PJR-001 has been updated as of 2/2/2016 and replaces the previous PJR-001 and replaces PJR-004. Whenever PJR-004 is listed as required on a form, use PJR-001 instead.

  • Check the revision date in each document's footer. Although PRMD is continuously working to maintain these documents, some may not reflect the requirements of the currently adopted, triennial code cycle. Please make use of the revision date in the footer of the document as a guide to identifying the currency of a particular document.

Coastal Permit

All forms listed must be completed for this permit type.

Coastal permits are required for development on parcels located within the Coastal Zone. Coastal permits are processed either administratively without a hearing, or with a public hearing, typically by the Board of Zoning Adjustments. Examples of administrative reviews include residences on the east side of Highway 1 and residences within established communities. All coastal permit applications include public notice to neighbors in the vicinity of the subject property and other parties who have requested notice.

Design Review

Design Review, Administrative – Commercial

The Sonoma County Zoning Code allows Administrative Design Review for (1) new commercial or industrial uses previously approved by use permit or design review, and for (2) minor facade changes or minor building additions for commercial or industrial uses. Additionally, new structures up to 10,000 square feet in urban areas may be eligible for Administrative Design Review. Administrative Design Review applications are evaluated in accordance with the provisions and development standards found in the Design Review section of the Sonoma County Zoning Code (Article 82). Design Review applications must also be consistent with applicable policies of the General Plan, Specific/Area Plans, and the Zoning Ordinance.

Design Review, Administrative – Residential

Many areas of Sonoma County have significant scenic resources. In an attempt to allow for development while preserving these resources, scenic areas have been designated as Scenic Resource (SR) or Scenic Design (SD). Administrative Design Review is conducted by a staff person in consultation with applicants. Agricultural structures (barns, stables, etc.) are exempt from design review except for properties subject to the Bennett Valley Area Plan and the Local Coastal Plan.

Lot Line Adjustment

A Lot Line Adjustment (LLA) is a realignment of boundary lines between two to four existing legal parcels (per Section 66412 of the Subdivision Map Act), where the land taken from one parcel is added to an adjacent parcel. This process is undertaken when the owner(s) of adjacent lots or parcels desire to change the shape, size, and/or location of the parcels.

Subdivision

Subdivision, Major

A major subdivision is a division of land into five (5) or more parcels. Major subdivisions are governed by the Subdivision Map Act (California Government Code, Section 66410, et. seq.), the Sonoma County Subdivision Ordinance (Sonoma County Code, Chapter 25), the Sonoma County Zoning Code (County Code, Chapter 26) and the Sonoma County General Plan.

Subdivision, Minor

A minor subdivision is a division of land into four (4) or fewer parcels. Minor subdivisions are governed by the Subdivision Map Act (California Government Code, Section 55410, et. Seq.) and the Sonoma County Subdivision Ordinance (Sonoma County Code, Chapter 25.) Minor subdivision application are also known as tentative parcel maps.

Use Permits

All forms listed under each permit type must be completed for that permit type.

A Use Permit application is required for development projects that are typically more intensive than Permitted Uses. Use Permit applications often require a public hearing before the Board of Zoning Adjustments; when processed with a Zone Change and/or a General Plan Amendment, the public hearing will be before the Planning Commission. Examples of uses requiring a Use Permit are: wineries, kennels, contractor storage yards, planned developments and mixed use projects. Use Permits are discretionary in nature, and, if approved, will include conditions of approval. A Use Permit can only be approved if found to be consistent with the Sonoma County General Plan, Sonoma County Zoning Code and, applicable Area or Specific Plan and if found to be compatible with the health, safety, and welfare of the neighborhood.

Variance from Zoning Regulations

A variance may be granted to provide relief from specific numerical standards in the zoning code such as setback requirements from property lines. Variances cannot be granted for relief from “use” provisions in the zoning code. If a proposed use is not permitted in a given zoning district, a variance cannot be granted to allow it.

Voluntary Merger

A voluntary merger of parcels (tax lots) which are in common ownership may be executed by an owner(s) to: 1. reduce taxes; 2. meet the Permit and Resource Management Department's (PRMD's) Well and Septic Division's requirement that a septic system be located entirely on one parcel; 3. respond to a determination by PRMD that parcels in common ownership are not separate legal lots. The result of the merger process is the recordation of the attached Voluntary Merger Notice at the County Recorder's Office. Thereafter, the County Assessor will assign one Parcel Number (APN) for the merged parcels (if possible). It may take the Assessor’s Office several months to assign a new APN for the merged parcels.

Zoning Change

A Zone Change can be proposed to change from one zoning district to another, to change the zoning density on a property, to remove a combining district, or to amend the text of the Sonoma County Zoning Code. Zone Change applications can also be required as a condition of a subdivision or a lot line adjustment approval. As all proposed Zone Changes must be consistent with adopted Area Plans and the General Plan, applicants should verify with planning staff if an Area Plan Amendment or General Plan Amendment must be filed in conjunction with the Zone Change.

Zoning Permits

Planning permits such as zoning permits may be required prior to the issuance of a building permit. Zoning clearances are required for building permits issued for new buildings, structures, or additions to existing buildings or structures. There may be additional setback requirements for a building depending upon the location near a scenic roadway or waterway. Additional review, such as administrative design review, may be required prior to the issuance of a building permit.

Hosted rentals are the rental of a single room or sleeping area within a single-family dwelling, where the property owner remains in residence. Hosted rentals do not include vacation rentals permitted in accordance with the Sonoma County Code for vacation rentals, or occasional home exchanges that are not otherwise subject to Transient Occupancy Tax (TOT). Hosted rentals must meet Performance Standards to ensure compatibility with surrounding residential uses.

Vacation rentals are the rental of a private residence for periods of 30 days or less. Vacation Rentals do not include Bed and Breakfast Inns or hosted rentals permitted in accordance with the Sonoma County Code for B&Bs and hosted rentals, or occasional home exchanges that are not otherwise subject to Transient Occupancy Tax (TOT). Vacation rentals must have a Certified Property Manager and meet Performance Standards to ensure compatibility with surrounding residential uses.
