JURY CONVICTS REPEAT OFFENDER ON 2 COUNTS OF FELONY DUI

District Attorney Stephan Passalacqua announced that Malcom Osgood McCoy was convicted by jury today of two counts of felony driving under the influence of an alcoholic beverage and having a 0.08% or higher blood alcohol content.

District Attorney Passalacqua said, “This prosecution exemplifies our commitment to ensuring the safety of all motorists on Sonoma County roads. This verdict sends a message to all impaired motorists that their actions will not be tolerated by this community.”

Mr. McCoy faces a maximum sentence of 4 years in prison and is scheduled to be sentenced by the Honorable Gary Medvigy on October 9, 2007. This was Mr. McCoy’s ninth conviction for DUI since 1986 and his blood alcohol level was measured at a .31, more than 3 times the legal limit.
