District Attorney Stephan Passalacqua announced today, the successful prosecution of Defendant Mark Delroy Daley. District Attorney Passalacqua stated, "I am hopeful this conviction will send a message to those who exploit children".
On February 24, 2005, Mark Delroy Daley was convicted of nine counts relating to providing methamphetamine to three fourteen-year-old girls and inducing them to prostitute themselves for money and lodging between April 3, 2003 and April 17, 2003. The case was prosecuted by DDA Marianna Lehr.
On April 3, 2003, two fourteen-year-old girls ran away from home. Daley, a thirty-two-year-old male, befriended them on the streets in downtown Santa Rosa. Daley persuaded them to have sex with another man in exchange for money and a place to stay for the night. In exchange for sex, the girls received methamphetamine, money and lodging before returning home.
Around April 15, 2003, one of the girls ran away from home again. This time she was accompanied by her twin sister. The girls encountered Daley in Denny’s Restaurant. Daley gave them methamphetamine and discussed setting them up with a male for sex. The twin sister felt pressured to have sex, and received money and methamphetamine for doing so.
SRPD Detective Karen Westling investigated the case and Det. Phil Brazis assisted in the investigation. On April 15, Brazis posed undercover as a customer interested in paying for sex with a young teen. During several audio-taped telephone conversations, Daley agreed to supply Brazis with a fifteen-year-old girl in exchange for money. On April 17, Daley delivered the twin sister as promised at a local hotel. Daley was arrested and taken into custody.
After a three day court-trial, the Honorable Robert P. Dale found Daley guilty of all nine counts. The maximum sentence Daly could receive is 17 years in State Prison. Judge Dale will sentence Daley on March 23, 2005.
