THREE HUNDRED-AND-TWO COUNTS FILED AGAINST FATHER

Today District Attorney Stephan Passalacqua stated that his office has filed an amended complaint in the case of People v. Kenneth Walter Brauer. Mr. Brauer was arrested by Petaluma Police on March 16, 2003. He was initially charged with one count of engaging in three or more acts of lewd and lascivious conduct on a child under fourteen years of age while the child resided with him. He was also charged with one count of exhibiting lewd material to a minor. His maximum incarceration for those two counts was sixteen years and eight months in state prison.

The ongoing investigation subsequently uncovered videotapes depicting Brauer engaging in sexual conduct with his six year old daughter. After a review of the videotapes, Deputy District Attorney Joan Risse amended the complaint to allege three hundred-and-two (302) counts of lewd and lascivious conduct on a child under fourteen years of age. Some of these counts also allege that the defendant engaged in substantial sexual conduct and exhibited pornographic material to the child. If convicted and sentenced consecutively on all counts, Brauer can be sentenced up to a maximum of six hundred-and-ten (610) years in state prison. The next court appearance is set for June 2, 2003, at which time a preliminary hearing is scheduled. Bail is currently set at $300,000.
